Welcome to StreetBitez LLC ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access and use of the StreetBitez platform, website, mobile application, and related services (collectively, the "Platform").

By using the Platform, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Platform.

1. About StreetBitez

StreetBitez LLC is a listing and discovery platform that connects users with local street food vendors. We do not prepare, handle, sell, or deliver food products. All food and beverage offerings are the sole responsibility of the individual vendors.

StreetBitez LLC does not independently verify the safety, quality, legality, or accuracy of vendor offerings or vendor-provided information.

2. Eligibility

You must be at least 13 years old to use the Platform. By using StreetBitez, you represent that you meet this age requirement.

3. User Accounts

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Please notify us immediately of any unauthorized use.

4. User Content

You may upload images, reviews, and other materials ("User Content"). You retain ownership of your content but grant StreetBitez a non-exclusive, worldwide, royalty-free license to use, display, and promote such content for the operation of the Platform.

You are responsible for ensuring your content does not violate any laws or third-party rights.

5. Content Moderation

StreetBitez reserves the right to review, remove, moderate, or disable any User Content at our sole discretion, including content that violates these Terms, infringes intellectual property rights, is misleading, offensive, unlawful, or harmful to the Platform or its users. We are not obligated to monitor all content but may do so at our discretion.

6. Copyright Complaints

If you believe content on StreetBitez infringes your copyright or intellectual property rights, please contact us at [email protected]. We may remove allegedly infringing content at our discretion pending review.

7. Subscriptions

Certain features of the Platform, including vendor tools, require a paid subscription. The following terms apply.

Vendor Plan

The Vendor Plan is available at the following pricing:

• Monthly: $19.99 per month
• Annual: $179.99 per year

Billing

Payment will be charged to your Apple ID account at confirmation of purchase. Your account will be charged for renewal within 24 hours prior to the end of the current billing period.

Auto-Renewal

The Vendor Plan automatically renews at the end of each billing period (monthly or annually) unless cancelled at least 24 hours before the renewal date.

Cancellation

You may cancel your subscription at any time through your Apple ID subscription settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for unused time.

8. Location Data

Information We Collect: Location data, when you choose to share it. For users, location data may be used to show nearby street food vendors on the discover map. For vendors, location data may be used to publish vendor listings and posts on the discover map.

Location sharing is optional. Users may browse the discover map without sharing their location, and vendors may manually enter an address or coordinates instead of using their device's current location.

Device Location Permissions: Location access allows users to discover nearby street food vendors and allows vendors to easily publish accurate location information for their listings or posts. Location access is optional and can be managed through your device settings at any time. Denying location access may limit certain location-based features.

Location Visibility: Vendor location information displayed on the discover map is public and visible to other users of the StreetBitez app. User location data is not publicly displayed. When users choose to share their location, it is used only to determine nearby vendors and improve map discovery.

Location Usage & Retention: We do not continuously track user location in the background. Location data is used only when location-based features are actively used within the app.

9. Prohibited Conduct

You agree not to:

• Use the Platform for illegal or unauthorized purposes.
• Upload false, misleading, harmful, or offensive content.
• Harass, abuse, or harm other users or vendors.
• Attempt to disrupt or compromise the Platform's integrity.
• Impersonate any person or entity.

10. Termination

We may suspend or terminate your account at any time for violations of these Terms or for any conduct that harms our users, vendors, or reputation.

11. Disclaimer of Warranties

StreetBitez LLC provides the Platform "as is" and makes no warranties of any kind, express or implied. We do not guarantee the availability, accuracy, or reliability of the Platform or any vendor information.

12. Limitation of Liability

To the maximum extent permitted by law, StreetBitez LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including any issues with food purchased from vendors.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute shall be resolved in the courts of Los Angeles County, California.

14. Changes to These Terms

We may update these Terms periodically. The updated date will be reflected above, and continued use of the Platform indicates acceptance of the new Terms.

15. App Store Distribution Terms

The following terms apply to your use of the StreetBitez mobile application distributed through the Apple App Store and are required by Apple's App Store distribution agreement.

15.1 Acknowledgement

You acknowledge that these Terms are concluded between you and StreetBitez LLC only, and not with Apple Inc. StreetBitez LLC, not Apple, is solely responsible for the StreetBitez app and its content.

15.2 Scope of License

Your license to use the StreetBitez app is a non-transferable license to use the app on any Apple-branded devices that you own or control, subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions. The app may be accessed by other accounts associated with you via Family Sharing or Legacy Contacts where applicable.

15.3 Maintenance and Support

StreetBitez LLC is solely responsible for providing maintenance and support services for the app. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the StreetBitez app.

15.4 Warranty

StreetBitez LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the app. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of StreetBitez LLC.

15.5 Product Claims

StreetBitez LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of the app, including but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

15.6 Intellectual Property

In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, StreetBitez LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

15.7 Legal Compliance

You represent and warrant that: (i) you are not located in a region subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" region; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

15.9 Third-Party Terms

You must comply with applicable third-party terms of service when using the app, including but not limited to your wireless carrier's data service agreement.

15.10 Third-Party Beneficiary

You acknowledge and agree that Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
